Liveflats.com Policy

Your use of Liveflats.com (the “Platform”) binds you—whether an Owner (legally owning or representing a listed property), Tenant (renting via the Platform), or Visitor—to these Terms of Service. We’ll notify you of updates via website, email, or in-app alerts with 30 days’ notice; continued use means you accept these legally enforceable terms.

Platform Role & Definitions

Liveflats.com operates strictly as a technology intermediary under Section 79 of the Information Technology Act, 2000, facilitating connections between Owners and Tenants. We do not own properties, act as agents, or assume liability for transactions. Our role is limited to enabling services like connecting tenants and owners, drafting digital rental agreements, collecting rent with ZohoBooks reporting, and coordinating maintenance, ensuring operational clarity and legal distance as a non-party to rental agreements.

User Responsibilities

Owners must prove legal ownership or authority, submit accurate property details (including encumbrances), and follow rental laws like the Karnataka Rent Act’s 11-month standard. Tenants must provide valid KYC (e.g., Aadhaar, PAN), comply with agreements, pay rent and utilities on time, and report damage beyond normal wear and tear. Late rent triggers penalties per the agreement or a default 2% monthly fee at the owner’s discretion. Subletting requires explicit written consent via the Platform—unauthorized subletting, fraud, or data misuse is forbidden. Users must not use the Platform for illegal activities (e.g., listing unowned properties), harassment, spamming, posting false listings, or violating third-party rights; violations may lead to account termination. KYC and background checks (police, court records, address verification) use third-party services—SignDesk (KYC and digital signatures) and GoldQuestGlobal (background verification)—per IT Rules, 2021, but accuracy isn’t guaranteed; users must verify independently.

Security Deposit & Payments

Service Fees: Owners will pay a property management fee determined by property specifics, location, and the contract between Liveflats.com and the Owner. Tenants pay an agreement fee and an annual renewal fee, divided equally between Tenant and Owner as per the fee set by Liveflats.com (shared per agreement). Property management, agreement, and renewal fees are non-refundable unless Liveflats.com fails to deliver contracted services, with refunds claimed within 7 days. Tenants pay security deposits directly to the owner’s account via bank transfer or UPI per the rental agreement—Liveflats.com does not facilitate or process these transactions. Refund terms (timeline, deductions) are solely between Tenant and Owner, and Liveflats.com explicitly disclaims liability for disputes. Rent follows owner instructions, processed and remitted within 24-48 hours, keeping payments direct. Optional service cancellations need 24 hours’ notice, with a 10% fee if started; we refund prepaid fees fully if we cancel due to glitches or vendor issues.

Data Protection

We secure your data with encryption and restricted access under the Digital Personal Data Protection Act, 2023 (DPDP Act), collecting and sharing it only with consent. Data storage and processing occur through us and third-party services—ZohoBooks (accounting), B2BBricks (sales CRM), SignDesk (KYC and digital signatures), and GoldQuestGlobal (background verification)—whose locations may be in India or abroad; check their policies. See our Privacy Policy at liveflats.com/privacy for detailed data practices. Breaches trigger a 72-hour user notification and legal compliance. Request data access or deletion via [email protected] or our app within 15 days. We’re not liable for third-party misuse or storage practices.

Critical Disclaimers

Tax Compliance: Tenants alone are responsible for TDS deductions under the Income Tax Act, 1961. Our TDS calculator is for guidance only and isn’t tax advice or service—Liveflats.com bears no liability for tenant tax obligations or errors. Rent Receipts: Issued by Owners or, per their instructions, by Liveflats.com on their behalf based on owner-provided information. Liveflats.com disclaims liability for inaccuracies, disputes, or legal issues arising from such receipts, which remain the Owner’s responsibility. Rent is processed per owner instructions, fees deducted, and the rest remitted within 24-48 hours under Section 79.

Liability Limitations

No Warranty: Properties are listed "as-is." We do not verify safety, legality, or ownership disputes—users must conduct their own due diligence. Third-Party Services: Maintenance vendors, Chartered Accountants (CAs), and insurers are independent; Liveflats.com disclaims liability for their acts or errors. Force Majeure: We’re not liable for delays or cancellations due to natural disasters, strikes, or government orders. User Waiver: By using the Platform, you waive all claims against Liveflats.com for losses (rent defaults, damages, disputes).

Dispute Resolution

Step 1: Parties must negotiate in good faith for 15 days to resolve disputes. Step 2: Unresolved disputes proceed to binding arbitration in Bengaluru under the Arbitration and Conciliation Act, 1996. Liveflats.com may provide documents (e.g., payment records) but will not mediate. Arbitration costs are borne by the initiating party unless agreed otherwise, with Bengaluru courts as the exclusive jurisdiction. Termination & Enforcement

By Liveflats.com: We may terminate accounts for fraud, non-payment, or policy violations with immediate effect. By Users: Users can close accounts via email with 7 days’ notice. Post-Termination: Clauses on payments, arbitration, and liability survive termination.

Rental Agreements

Agreements follow an 11-month standard (renewable). Stamp duty is split equally between Owner and Tenant unless Karnataka law mandates otherwise. Requires Aadhaar eSign and full KYC compliance. Property rules (e.g., pets, smoking) are set by Owners and enforced per the rental agreement; Liveflats.com bears no responsibility.

Maintenance

Emergencies (e.g., leaks) are resolved within 24 hours; non-urgent issues within 3–5 days. Maintenance vendors are third-party providers, and Liveflats.com bears no liability for their performance. For unresolved emergencies, contact[email protected] for escalation.

Miscellaneous

Intellectual Property: All Platform content (e.g., listings, templates) is owned by Liveflats.com or its licensors. Users grant us a non-exclusive, royalty-free license to use uploaded content for Platform purposes. We’re not liable for IP disputes from user content. Amendments: Liveflats.com may amend these terms with 30 days’ notice via email or in-app alerts; continued use implies consent. Governing Law: This policy is governed by Indian law, with exclusive jurisdiction in Bengaluru courts. Liveflats App: Liveflats.com offers a user-friendly mobile app available on Google Play Store and Apple App Store. Owners can track rental payments, maintenance updates, and agreements; Tenants can raise service requests, view agreements, and get instant support. Features include instant notifications, support chat, and real-time payment tracking. We uphold Section 79 with a Take-Down Policy and compliance checks. Accessibility aligns with the Rights of Persons with Disabilities Act, 2016.
